DRAFT — These terms are a template for Kevin to review with legal counsel before operating the concierge service commercially.
1. Agreement to terms
By submitting a trip inquiry or booking a trip through TrailSendr (the “Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.
2. What TrailSendr does
TrailSendr is a trip-planning concierge service. We coordinate third-party vendors on your behalf — including lodging providers, bike rental shops, shuttle operators, ground transport, and restaurants. We are not the provider of these services. Your contractual relationship for each service is with the respective vendor.
We do not sell airline tickets or air travel. You are responsible for arranging and paying for your own air travel.
3. Quotes and bookings
After you submit an inquiry, we prepare a proposed itinerary and quote. Prices include third-party costs plus our service fee and markup. Quotes are valid for 7 days unless otherwise stated. Quotes become binding bookings only when you pay the deposit.
4. Payments
A non-refundable deposit of [X%] is due to confirm your trip. The balance is due [X days] before your trip start date. Payments are processed via Stripe. All amounts in USD.

6. Assumption of risk
Mountain biking carries inherent risks including injury, death, and property damage. You acknowledge and accept these risks. TrailSendr is not responsible for injuries, accidents, or losses that occur during your trip. Each vendor (shuttle operator, bike shop, etc.) has their own waivers and terms — you agree to comply with all vendor terms and sign their required waivers.
7. Vendor performance
We select vendors based on reputation and our experience, but we do not control their operations. We are not liable for vendor cancellations, equipment failures, schedule changes, or service quality issues. If a vendor cancels or fails to perform, we will work to find alternatives or refund amounts paid to that vendor (if recoverable from them).
8. Limitation of liability
To the maximum extent permitted by law, TrailSendr's total liability for any claim arising from your trip is limited to the service fees you paid to TrailSendr (not including pass-through vendor costs). We are not liable for indirect, incidental, consequential, or punitive damages.
9. Force majeure
We are not liable for failures caused by events outside our reasonable control, including weather, natural disasters, fires, pandemics, trail closures, permit revocations, or vendor bankruptcy.
10. Governing law
These terms are governed by the laws of [STATE OF LLC], USA. Any disputes will be resolved in the state and federal courts located in [COUNTY, STATE].
